Producer of false attack ad is released from lawsuit

The man who produced a false attack ad against Wichita mayor Brandon Whipple has been released from a lawsuit over the ad.

An attorney for Matthew Colburn said Friday that Colburn had produced material to Whipple’s attorneys, including a recording of several lawmakers discussing the ad.  KFDI’s news partners at KWCH reported that the audio was secretly recorded by Colburn of a discussion involving Sedgwick County Commissioner Michael O’Donnell, Wichita city council member James Clendenin, and State Representative Michael Capps.    The discussion involved placing blame for the false attack ad.

The attack aid was aimed at Whipple during his campaign for the mayor’s office last year, and it falsely stated that Whipple was involved in sexual harassment.  The ad contained quotes that were actually from a Kansas City Star article that did not involve Whipple.

A lawsuit was filed by Whipple over the attack ad.  O’Donnell has denied involvement in the ad and he had stated an intent to file a countersuit.
